The bank examination privilege is a disclosure protection that applies to materials prepared for, and communications with, certain financial institutions’ regulatory agencies. Unlike the attorney-client privilege, the bank examination privilege belongs to the agencies and not to the banks. This program will provide an overview of the privilege, and discuss current issues related to the privilege in litigation and other contexts. The presenters include the authors of the new legal treatise, The Bank Examination Privilege, which was published in January, 2017 by the American Bar Association.
