President Trump’s America First Investment Policy (AFIP) has the potential to drastically alter cross border investments, particularly those involving the United States and the People’s Republic of China. Although it will take some time for the required Congressional, agency, and regulatory actions to occur to implement the Policy, President Trump makes clear that investments from Chinese companies in the United States, and from U.S. persons in Chinese companies, will be scrutinized more heavily than they already are and, in some instances, may be blocked entirely. Larry Ward, Chair of Dorsey’s National Security Law group, and Justin Huff, former U.S. Treasury Department official, will lead a discussion on how the AFIP will alter the landscape of the Committee on Foreign Investment in the United States (CFIUS) and the Treasury Department’s outbound investment program.
