Overview

Nate helps clients achieve their objectives by guiding them through intricate regulatory and statutory schemes and related litigation, leveraging his industry knowledge and experience, and providing zealous representation at every stage of a dispute.

A litigator in Dorsey’s Regulatory Affairs Group, Nate’s practice focuses on environmental and regulatory litigation and appeals, P3 and construction/design litigation, administrative disputes and appeals, and regulatory compliance and enforcement. Prior to joining Dorsey, Nate served as a judicial law clerk for Justice Margaret H. Chutich at the Minnesota Supreme Court. In law school, Nate served as an editor of the Minnesota Law Review.

Representative Litigation

Environmental/Regulatory Litigation

  • Represent state political subdivision in NEPA lawsuit seeking increased environmental review of $600 million gondola infrastructure project.
  • Represent parties seeking increased environmental review of $100 million street redesign project in regulatory review process and in subsequent certiorari appeal proceedings. 
  • Represent manufacturer in toxic-mass-tort litigation alleging multi-million-dollar wrongful death claims.
  • Represent power distribution cooperative in multi-million-dollar PURPA suit against municipal power consumer.
  • Represent power generation and transmission cooperative in multi-million-dollar suit against member distribution cooperative over application of rate formula and membership in power supply agreement. 
  • Represent food and food-packaging manufacturers in numerous consumer-fraud class actions alleging food mis-labeling claims under various consumer protection statutes and federal regulations.

Construction and Design/P3 Litigation

  • Worked on litigation team defending $112-million claim in P3 dispute in Denver Transit Partners v. Regional Transportation District [of Denver], venued in Denver County District Court, Colorado and arising out of the $2.2 billion Eagle P3 Commuter Rail Project. 
  • Represent construction and design clients in dispute alleging noncompliance with ADA statutory and regulatory provisions. 

Administrative Disputes and Appeals

  • Worked on litigation team in In re Matter of the Dam Safety and Public Waters Work Permit Application for the Fargo-Moorhead Flood Risk Management Project, Clay and Wilkin Counties (OAH 65-2002-34309) representing Fargo-Moorhead Flood Diversion Board Authority in environmental approval of $3 billion Fargo-Moorhead Diversion Project.
  • Represent Clean-Air-Act permittee in certiorari appeal against MPCA contesting terms of amended Clean-Air-Act permit obligations.  
  • Represent local health care providers in contested case proceedings appealing State of Minnesota’s administration of healthcare provider surcharge program.

Regulatory Compliance and Enforcement

  • Represent ATV importer and manufacturer in enforcement dispute with CPSC over importation of electric scooters and in negotiations with CPSC over Comprehensive ATV Safety Plan. 
  • Counsel heavily-regulated clients in CERCLA obligations related to mineral exploration and testing activities.
  • Counsel manufacturing clients in non-litigated disputes with regulators over application of Clean Air Act obligations.
  • Counsel mining clients on compliance with statutes and regulations governing water use, land use, and mineral exploration.
