LINDSEY HELPS CLIENTS DEVISE CREATIVE and Effective STRATEGIES TO EXPAND, PROTECT, AND diversify THEIR intellectual property and BRAND PORTFOLIOS AROUND THE WORLD.

For nearly a decade, Lindsey has offered sophisticated, cutting-edge client service in all areas of intellectual property, including trademarks, copyrights, advertising, entertainment and media, and domain name and Internet enforcement work.

Much of Lindsey’s practice involves enforcing and protecting her client’s rights across a vast spectrum. She is particularly effective at contentious work, channeling her background in trademark and patent litigation to advise clients through opposition and cancellation proceedings both in the United States and abroad, as well as social media takedowns and domain name registration disputes.  

As part of the firm's top-ranked trademark team, Lindsey’s knowledge and experience is also applied to all stages of the brand management process, including trademark selection, clearance, prosecution, maintenance, enforcement, and litigation. Her clients span an array of industries, from technology, fashion, sporting goods, and cosmetics to mining, pharmaceuticals, financial services, and renewable energy.

Lindsey also guides clients through all aspects of entertainment and media law, including negotiations, publishing and talent agreements, and sponsorship contracts.  In addition, Lindsey works with Fortune 500 technology companies with review of their public-facing advertising and marketing materials, helping these clients to protect their high-profile and publicly integrated brands and images.  

In 2018, Lindsey was selected by Law Week Colorado as one of seven attorneys in the Denver Metro area for their Up and Coming attorney list. She is a contributor to Dorsey’s critically-acclaimed IP Blog, TheTMCA.com, which focuses on legal developments in the world of TradeMarks, Copyrights, and Advertising. Both the TheTMCA.com and the Firm’s Trademark Practice Group have been recognized in JD Supra’s 2022 Readers’ Choice Awards. Lindsey is also a contributing author to Law360, founder of Dorsey’s Sustainability Committee, and a recipient of Dorsey’s Scales of Justice award for excellence in pro bono service.

Trademark and Intellectual Property Enforcement

  • Protect world-famous brands and develop international trademark enforcement strategies for institutional clients.
  • Advise clients on enforcement measures for misappropriation of trademarks, including demand letters, litigation, and trademark coexistence agreements.
  • Represent clients before the Trademark Trial and Appeal Board in trademark opposition and cancellation proceedings.
  • Develop international trademark enforcement strategies to protect the strength of clients’ portfolios.
  • File and prosecute Uniform Domain-Name Dispute-Resolution Policy (UDRP) complaints resulting in recovery of domain names for clients. Representative Cases:
    • Barrick Gold of North America v. Unknown, WIPO Case No. D2023-2177 (2023).  Successfully represented international mining company in Uniform Domain Name Dispute Resolution Policy (UDRP) proceeding to recover domain name related to client’s core brand, BARRICK, from defendant who was impersonating an employee to commit financial fraud and theft.
    • Kibali Goldmines SA v. Evans Wesonga, WIPO Case No. D2023-0905 (2023).  Successfully represented international mining company in Uniform Domain Name Dispute Resolution Policy (UDRP) proceeding to recover domain name related to client’s brand, KIBALI, from defendant in an international financial phishing scheme.
    • Proctor.io Incorporated v. Zhi Chao Yang, WIPO Case No. D2022-4330 (2022). Successfully represented education technology company in Uniform Domain Name Dispute Resolution Policy (UDRP) proceeding to recover fourteen domain names related to client’s core brand, PROCTORIO.

Trademark Clearance, Prosecution, and Maintenance

  • Provide counsel on the development, availability, registrability, and strength of proposed trademarks.
  • Conduct trademark clearance searches.
  • Coordinate international trademark portfolios for industry-leading clients.
  • Work with local counsel to prosecute and maintain international trademark portfolios.
  • Prepare and negotiate trademark license, coexistence, and settlement agreements.
