Overview

MARISA BAVAND PROVIDES COUNSEL AND LITIGATION SERVICES TO CONSTRUCTION INDUSTRY AND GOVERNMENT CONTRACT CLIENTS.

Marisa is a seasoned counselor and litigator for her construction and government contract clients with wide-ranging experience in advising clients in all aspects of construction projects and government procurement law. Her practice includes representing contractors, developers, and engineers with navigating alternative delivery methods, pre-project planning and risk assessment, contract drafting, claim management and preservation, and litigating disputes. Marisa provides strategic advice and litigation representation on a large variety of projects including heavy civil, light rail, highway, bridges and tunnels, public infrastructure, universities, production facilities, fire stations, mixed use commercial projects, and various vertical construction projects.

Marisa also has a national practice in procurement law and government contracting. She assists clients in navigating the Federal Acquisition Regulations, the Contract Disputes Act and the complicated implications associated with contracting with the government. She advises clients through the procurement process, contract drafting and interpretation, training, compliance issues, audits and investigations and developing requests for equitable adjustments and claim development. She has litigated matters on behalf of her clients in the Federal Court of Claims, the Civilian Board of Contract Appeals, and the Armed Services Board of Contract Appeals. She has extensive experience in contracts with the Department of Energy, the Department of Defense, and the United States Army Corps of Engineers across the United States. Marisa further handles United States Department of Justice (DOJ) investigations and litigation of False Claims Act claims. She has managed extensive DOJ Civil Investigative Demands and succeeded in avoiding fraud-based liability for her clients through negotiated resolutions.  

Marisa further assists clients in Federal grant procurement and compliance pursuant to 2 C.F.R. 200, Small Business Act eligibility, compliance and litigation, and assists Alaska Native Corporations and tribal organizations extensively in government contracting, construction, and remediation matters.
