Global software developer wins big in arbitration over damages
A global developer of computer backup and disaster recovery software was awarded $3 million in damages after securing an injunction.
Our client previously won a suit for permanent injunctive relief in U.S. District Court against former distributors that had breached their agreements with it. The injunction prohibited these distributors from using the client’s customer lists, pricing information, trade secrets, confidential information, and from competing directly or indirectly with its business. The court also compelled binding arbitration to determine damages. After a full evidentiary hearing, the arbitration panel awarded our client more than $3 million in damages, costs, and attorney’s fees.
